TOT BOX 5280 – TERMS OF SERVICE
Tiny Smiles. Big Memories.
This Agreement is entered into by and between Tot Box 5280 (“Company”) and {{client_name}} (“Client”) for services to be provided on {{event_date}} at {{event_time}} at 2245 Main Street, Suite 6, Superior CO 80027.
1. DESCRIPTION OF SERVICES
Tot Box 5280 provides a modern, styled mini-session photography experience designed for children, families, and pets. Services may include: • 30-minute studio session inside the Tot Box setup • Professionally edited digital images • Seasonal or themed styling elements • Online gallery delivery • Optional add-ons and additional image purchases. Final services are based on the Client’s selected package and any additional purchases.
2. BOOKING & PAYMENT TERMS
Full payment is required at the time of booking to reserve your session. All bookings are non-refundable. Sessions are not confirmed until payment is received in full. No services will be rendered without full payment.
3. CANCELLATION POLICY
Client-Initiated Cancellations: More than 48 hours prior to session: session may be rescheduled; a fee may apply. Within 48 hours of session: payment is forfeited. Company-Initiated Cancellations: If Company must cancel due to illness, emergency, or unforeseen circumstances, Client will be offered a rescheduled session or full refund.
4. REFUND POLICY
Refunds will not be issued under any circumstances, including but not limited to missed sessions or late arrivals, child or participant non-cooperation, or dissatisfaction with expressions, poses, or participation.
5. SESSION REQUIREMENTS & EXPECTATIONS
Client agrees to arrive on time and fully prepared for the session, supervise children at all times, and understand that sessions are fast-paced and designed to capture natural moments. Tot Box 5280 does not guarantee specific poses, expressions, or outcomes.
6. STUDIO CONDUCT & DAMAGE
Client agrees to ensure safe and respectful use of the studio, props, and equipment and to be financially responsible for any damage caused by Client or guests. Company reserves the right to end a session due to unsafe or disruptive behavior without refund.
7. PERFORMANCE LIMITATIONS
While we strive to create a seamless experience, Company cannot guarantee specific child behavior or cooperation, identical results to prior sessions or marketing images, or exact outcomes due to lighting, mood, or participant engagement.
8. IMAGE DELIVERY
Images will be delivered via an online gallery. Standard turnaround time is up to 10 business days. Additional images may be available for purchase. Company is not responsible for delivery issues caused by incorrect email addresses or technical limitations.
9. CUSTOMIZATION & ADD-ONS
Custom styling, themes, or special requests may require additional fees and must be approved in advance. Availability of props and styling elements may vary.
10. USE OF PHOTOS & PRIVACY
A separate Model Release will be provided for marketing and promotional use of images. Client consent is optional and must be selected at the time of signing.
11. FORCE MAJEURE
Company is not liable for failure to perform due to circumstances beyond its control, including but not limited to illness, weather, emergencies, or acts of God.
12. LIABILITY
Liability is limited to the total amount paid by Client. Company is not responsible for injury resulting from misuse of props or equipment.
13. INDEMNIFICATION
Client agrees to indemnify and hold harmless Tot Box 5280 from any claims, damages, or liabilities arising from participation in the session.
14. GOVERNING LAW
This Agreement shall be governed by the laws of the State of Colorado.
15. ENTIRE AGREEMENT
These Terms, along with your booking confirmation, represent the entire agreement.
16. CLIENT ACKNOWLEDGMENT
By completing your booking, Client acknowledges that they have read, understood, and agreed to these Terms of Service.
